Federal Judge Orders Release of Abrego Garcia from ICE Custody
A court has ordered the prompt discharge of Kilmar Abrego Garcia from detention by ICE, finding his ongoing confinement is without lawful basis.
"Since his return from wrongful imprisonment in El Salvador, he has been re-detained, again without legal justification," the judge wrote in her ruling.
The case originates in a mistaken removal to El Salvador earlier this year, which the government later admitted was an error. Following his return to the United States to answer human smuggling allegations, he was held in federal detention.
In her decision, the judge pointed out that the authorities does not have a valid deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this juncture."
Background of the Legal Challenge
The legal challenge involve conflicting assertions. While the former administration contends that Abrego Garcia is a affiliate of the MS-13 gang, he vehemently denies this claim.
He has also entered a not guilty plea to the conspiracy counts, which are part of a separate criminal case in Tennessee.
Conditions of Freedom
The judge, who was overseeing his petition to removal in a federal court, determined that he must now comply with the terms of his bond from jail in Tennessee. This order effectively transfers his monitoring to the Tennessee court.
This decision represents a significant turn in a complicated immigration battle featuring claims of mistaken imprisonment and contested gang associations.
